Terms of Service

These Terms of Service ("Terms") govern your use of the FarSight XR mobile app (the "App"), provided by FarSight XR, LLC ("FarSight XR," "we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Who can use the App

The App is designed for learners ages 4 and up, including children. If you are under 18, or under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. Purchases and subscriptions must be made by an adult or with a parent's or guardian's permission. Schools and organizations using the App on behalf of students are responsible for obtaining any consent required by law.

2. License to use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for personal, family, or educational use, subject to these Terms and the usage rules of the app store you downloaded it from. You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works from the App or its content, except as permitted by law.

3. Free and paid content

Some AR experiences and content are free. Other content requires a one-time purchase or an active subscription. Some content is unlocked by scanning a FarSight XR physical product (such as a poster or book) with the App, with no additional purchase required. We may add, change, or remove content and features over time.

4. Purchases and subscriptions

  • Billing. All purchases are processed by Apple (App Store) or Google (Google Play), depending on where you downloaded the App, and are subject to that store's terms and payment policies. We do not receive or store your payment card information.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the current period ends.
  • Free trials. If a subscription includes a free trial, you will be charged when the trial ends unless you cancel before then. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
  • Managing and canceling. You can manage or cancel subscriptions in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
  • Refunds. Refund requests are handled by Apple or Google under their refund policies. We cannot directly issue refunds for store purchases.
  • Family Sharing. Where supported by your app store, eligible purchases and subscriptions may be shared with family members according to that store's family sharing rules.
  • Price changes. We may change prices. Your app store will notify you of subscription price changes as required.

5. Third-party content and links

The App may display or link to third-party websites and content, such as Wikipedia pages and embedded videos, inside an in-app web view. We do not control and are not responsible for third-party content, availability, or privacy practices. Your use of third-party sites is subject to their own terms. Link-following may be limited for younger users or in education settings.

6. Acceptable use

You agree not to: use the App for any unlawful purpose; attempt to bypass purchase or content restrictions; interfere with or disrupt the App; or use the App in a way that could harm others.

7. Safety

The App uses augmented reality, which places digital content over your real surroundings. Please follow the safety notice shown when the App starts, stay aware of your environment, and do not use the App while driving or walking in unsafe areas. Younger children may benefit from help or supervision from a parent or another adult. We are not responsible for injury or damage resulting from failure to pay attention to your surroundings.

8. Intellectual property

The App, including its software, design, original 3D models, narration, artwork, and text, is owned by FarSight XR, LLC or its licensors and is protected by intellectual property laws. FarSight XR is a registered trademark of FarSight XR, LLC. Some content in the App comes from third parties and is used under public domain dedications (such as CC0), Creative Commons, or other open licenses. That content remains subject to its original license, and nothing in these Terms limits any rights you have under those licenses. Where a license requires attribution, credits are provided in the App or on our website. These Terms do not grant you any ownership rights in the App or its content.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect and how we use it.

10. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. Educational content, including anatomy and science content, is provided for general learning purposes only and may not be complete or error-free. The App is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It is not a substitute for professional medical advice. Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment. We do not guarantee that the App will be uninterrupted, error-free, or compatible with every device.

11. Limitation of liability

To the fullest extent permitted by law, FarSight XR, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App will not exceed the amount you paid for the App or in-app purchases in the 12 months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Termination

We may suspend or end your access to the App if you violate these Terms. You may stop using the App at any time by deleting it. Sections that by their nature should survive termination will survive.

13. Apple-specific terms

If you downloaded the App from the Apple App Store, you acknowledge that: these Terms are between you and FarSight XR, LLC only, not Apple; Apple has no obligation to provide maintenance or support for the App; if the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, and Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims; Apple is not responsible for any third-party claim that the App infringes intellectual property rights; you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Google Play

If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, except where your local consumer protection laws require otherwise.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date. Continued use of the App after changes take effect means you accept the updated Terms.
